How Much More to Wait Until I Get My Green Card  

If you applied for a “green card” through your company you have to complete a three-step process before you get your “card”.  

The first step is to get an approved labor certification from the Department of Labor (DOL).  This has two sub-steps

  • First, you file your case with the State DOL.  If everything goes well the State DOL will transfer your case to the US DOL in your region (Regional DOL).

  • The second sub-step is the Regional DOL reviewing your case and giving you an approved labor certification  if everything is done correctly.

The second step after getting an approved labor certification is to file an Immigrant Petition for Alien Worker (I-140) with your regional INS office.  To find out the processing time for I-140’s please click here

The third step is to apply for a GC interview once INS approves your I-140.  You may be able to have a GC interview in the U.S.  To do so you need to file form I-485 with your regional INS office.    To find out the processing time for I-485’s please click here

You also maybe able to have your GC interview at the U.S. Embassy in your home country.  Please click here to fine out how to contact the Embassy in your country to try to get an idea of how long you will have to wait for the interview and the procedure at the Embassy.   

Whether it is better to have the GC interview in the U.S. or in your home country is a complicated question that you should discus with an experienced immigration attorney.  The wrong choice could result in your GC being denied.
